Terms and Conditions of the 4CyberCity Platform
- Introductory Provisions
 
1.1 These Terms and Conditions govern the rights and obligations between 4Cyber s.r.o., ID No.: 22094458, with its registered office at Zelený pruh 95/97, Prague 4 – Braník, ZIP 140 00 (hereinafter referred to as the “Provider”) and the customer (hereinafter referred to as the “Customer”) who uses the e-learning platform 4CyberCity, available at https://4cybercity.cz.
1.2 The Customer is a legal entity or an entrepreneur who orders access to training or another digital service provided through the platform.
1.3 By using the platform or ordering a service, the Customer confirms that they have read and agree to these Terms and Conditions.
- Description of Service
 
2.1 The Provider operates an online educational platform designed for employee training in the field of cybersecurity.
2.2 The platform includes:
- learning modules, tests, challenges, and attack simulations,
 - automatic knowledge evaluation and certificate generation,
 - export of results for internal audit or reporting purposes.
 
2.3 The platform is designed for easy deployment without the need for integration into internal infrastructure.
2.4 The content has an educational and preventive character – it does not replace professional consulting, auditing, or penetration testing.
2.5 The Provider may continuously update and expand the content without prior notice.
- Orders and Contract Conclusion
 
3.1 Orders can be placed via the web form, email, or a written contract.
3.2 The contract is concluded upon confirmation of the order by the Provider.
3.3 The Provider reserves the right to reject any order without stating a reason.
3.4 Access to the platform is time-limited according to the agreed license.
- Price and Payment Terms
 
4.1 Prices are stated excluding VAT, unless specified otherwise.
4.2 Payment is made cashless by bank transfer or via a payment gateway.
4.3 Access to the platform is activated after the payment is received, unless agreed otherwise.
4.4 For recurring services, the Provider may unilaterally adjust the price, and the Customer will be notified at least 30 days in advance.
- User Account
 
5.1 Each user receives unique login credentials.
5.2 The Customer is responsible for maintaining the confidentiality and protection of these credentials and for any actions performed under their account.
5.3 Sharing login credentials without the Provider’s written consent is prohibited.
5.4 The Provider is entitled to temporarily or permanently suspend access in case of suspected misuse, breach of terms, or interference with the system.
- Intellectual Property
 
6.1 All content of the platform (lessons, texts, videos, tests, graphics, data, software, etc.) is protected by copyright and remains the property of the Provider or its partners.
6.2 The license is non-exclusive, non-transferable, and time-limited for the duration of the contract.
6.3 Any copying, distribution, modification, or public disclosure of content without the Provider’s written consent is prohibited.
6.4 Violation of intellectual property rights may be considered a breach of contract and may result in termination of access without compensation.
- Liability and Warranty Limitations
 
7.1 The Provider offers services “as is”, without warranty that their use will achieve a specific result or ensure complete protection against cyber incidents.
7.2 The Provider is not liable for:
- damage caused by incorrect or unauthorized use of the platform,
 - loss of data, profits, or any consequential damages,
 - damage resulting from cyberattacks, infrastructure failures, or decisions made based on platform content,
 - technical issues on the Customer’s side (e.g., insufficient device security, internet connection, antivirus protection).
 
7.3 The content of the platform has an educational purpose and serves to raise security awareness. The Provider does not guarantee that applying the acquired knowledge will prevent all attacks or damages.
7.4 The Provider does not guarantee uninterrupted system availability; short outages due to maintenance, updates, or force majeure are not considered a breach of contract.
7.5 The maximum liability for damages from any cause is limited to the amount paid for the provided service.
7.6 The Customer acknowledges that using the educational content is at their own risk.
- Complaints
 
8.1 Complaints can be submitted in writing to info@4cyber.cz.
8.2 The Provider is obliged to process the complaint within 14 days of its receipt, unless otherwise agreed.
8.3 Complaints do not apply to interruptions or limitations of service caused by maintenance, updates, or third-party actions.
- Personal Data Protection
 
9.1 The Provider processes personal data in accordance with the GDPR and Act No. 110/2019 Coll.
9.2 Data is processed solely for the operation of the platform, training delivery, and certificate issuance.
9.3 Details are provided in separate documents: the Personal Data Processing Policy and the Cookie Policy available on the website.
- Final Provisions
 
10.1 The Provider may modify these Terms and Conditions at any time; the current version is always published on the website.
10.2 The legal relationship between the Provider and the Customer is governed by the laws of the Czech Republic.
10.3 All disputes shall be resolved by the competent court of the Provider’s jurisdiction.
10.4 These Terms and Conditions become effective on July 7, 2025.
